SimpliFinance Ltd is the controller of the personal information described in this notice. This means that we determine how and why personal information is collected and used.

Information we collect
The information we collect depends on the service you request. It may include:
your name, address, date of birth, telephone number and email address;
information about your family, relationships and personal circumstances;
information about proposed executors, guardians, beneficiaries and other people named in your instructions;
information about your assets, liabilities, property, business interests and wishes;
the answers provided through our will questionnaire;
correspondence, enquiries and customer-service records;
order, payment and transaction information;
drafts and completed copies of documents prepared for you;
information relevant to whether our service is suitable for your circumstances; and
technical information about your use of our website, including IP address, browser information and cookie preferences, where collected.
You may provide information about other people, including family members, executors, guardians and beneficiaries. Please only provide information that is reasonably necessary for your will instructions.
How we collect information
We collect information:
when you use our website or complete our online questionnaire;
when you contact us by email, telephone or another communication method;
when you place an order or make a payment;
when another person contacts us with your authority; and
automatically through website-hosting systems, cookies and similar technologies.
Why we use your information
Enquiries
We use your information to respond to questions, explain our services and take steps requested by you before entering into a contract.
Our lawful basis is taking steps at your request before entering into a contract and our legitimate interest in responding to enquiries.
Providing the will-writing service
We use your information to:
assess whether our service is suitable;
review the information you provide;
seek clarification where necessary;
prepare your documents;
communicate with you about your instructions; and
provide guidance on signing and witnessing your will.
Our primary lawful basis is that the processing is necessary to perform our contract with you or to take steps at your request before entering into that contract.
Where your instructions contain information about beneficiaries, executors, guardians or other people, we process that information on the basis of our legitimate interest in accurately recording your instructions and providing the requested service.
Payments and business administration
We use order and transaction information to process payments, issue confirmations, maintain financial records, handle refunds and manage the business.
Our lawful bases are performance of our contract, compliance with legal obligations and our legitimate interests in administering the business.
Payments are processed by PayPal. SimpliWills does not receive or retain your full payment-card details. PayPal processes payment information under its own privacy terms.
Complaints, legal obligations and claims
We may retain and use information to handle questions or complaints, comply with legal and taxation obligations, prevent fraud and establish, exercise or defend legal claims.
Our lawful bases are legal obligation and our legitimate interests in protecting customers and the business.
Marketing
We will only send electronic marketing where we have an appropriate lawful basis and have complied with applicable electronic-marketing requirements.
You can unsubscribe at any time. We may retain a minimal suppression record so that we can respect your request not to receive further marketing.
Information about other people
Your instructions may include information about family members, executors, guardians, beneficiaries and other individuals.
We use this information only where reasonably necessary to record and act upon your instructions. We do not use their information to market services to them.
Where appropriate, you should make those individuals aware that you have supplied their information and direct them to this privacy notice.
Who we share information with
Where necessary, information may be processed or shared with:
Hostinger, which hosts and supports our website;
Google, where Google Forms, Google Drive or related services are used to collect or store your information;
PayPal, which processes payments;
LawDepot, where its document-preparation systems are used to prepare your will;
email, file-storage, security and communications providers;
accountants, insurers and professional advisers;
relevant specialists where you have asked us to make an introduction or authorised us to share information;
courts, regulators, law-enforcement bodies or public authorities where legally required; and
another organisation if the business is sold, transferred or reorganised, subject to appropriate confidentiality and data-protection arrangements.
Service providers acting on our behalf are expected to protect personal information and use it only for the services they provide.
We do not sell personal information.
LawDepot should remain in this section only if you enter identifiable customer information into its system. If you merely use blank wording or templates without entering customer details, remove it.
International processing
Some of our technology and payment providers may process information outside the United Kingdom.
Where a restricted international transfer takes place, we take reasonable steps to use providers that implement an appropriate transfer mechanism, such as UK adequacy regulations or approved contractual safeguards.

How long we keep information
We keep personal information only for as long as reasonably necessary for the reason it was collected.
Our usual retention periods are:
enquiries that do not proceed: 12 months after the last meaningful contact;
completed will questionnaires, instructions, drafts, correspondence and client records: for the client’s lifetime and for six years after we are notified of their death;
files relating to a cancelled or replaced will: normally six years after cancellation or replacement, unless there is an appropriate reason to retain them for longer;
payment, invoice and accounting records: six years from the end of the relevant company financial year; and
marketing preferences and suppression records: for as long as reasonably necessary to respect the individual’s communication choice.
We may retain information for longer where required by law, our insurer, an unresolved complaint or the need to establish, exercise or defend a legal claim.
Paper documents are securely destroyed once they have been accurately scanned and we are satisfied that the paper version is no longer required.
When electronic information reaches the end of its retention period, it will be securely deleted, anonymised or placed beyond normal use.
How we protect information
We use reasonable technical and organisational safeguards designed to protect personal information against accidental loss, unauthorised access, alteration or disclosure.
These safeguards include password protection, restricted access, device security, secure backups and appropriate security settings for the systems we use.
No electronic storage or transmission system can be guaranteed to be completely secure.
Your rights
Depending on the circumstances and the lawful basis used, you may have the right to:
request access to your personal information;
ask us to correct inaccurate or incomplete information;
ask us to delete information;
